REPORT

FEMA is providing this report on Section 106 compliance actions carried out under the Louisiana State-Specific Programmatic Agreement among FEMA, then Louisiana State Historic Preservation Officer of the Department of Culture Recreation and Tourism (SHPO), the Louisiana Governor's Office of Homeland Security and Emergency Preparedness (GOHSEP), the Alabama-Coushatta Tribe of Texas (ACTT), the Chitimacha Tribe of Louisiana (CTL), the Choctaw Nation of Oklahoma (CNO), the Jena Band of Choctaw Indians (JBCI), the Mississippi Band of Choctaw Indians (MBCI), the Seminole Tribe of Florida (STF), and the Advisory Council on Historic Preservation (ACHP) Regarding FEMA's Hazard Mitigation Grant Program (LA HMGP PA) dated January 31st, 2011 for the six month period between February 1 and July 29, 2011 pursuant to Stipulation XV.

The Federal Emergency Management Agency (FEMA), the Louisiana State Historic Preservation Officer of the Department of Culture Recreation and Tourism (SHPO), the Louisiana Governor's Office of Homeland Security and Emergency Preparedness (GOHSEP), and the Advisory Council on Historic Preservation (ACHP) executed the Louisiana Hazard Mitigation Grant Program Programmatic Agreement (LA HMGP PA) on January 31st, 2011; thus, the LA HMGP PA went into effect in the State of Louisiana on this date.

The Jena Band of Choctaw Indians signed the LA HMGP PA on February 8, 2011. Tribes that are recognized as Participating Tribes in the document and have not yet signed the LA HMGP PA include: The Alabama-Coushatta Tribe of Texas (ACTT), the Chitimacha Tribe of Louisiana (CTL), the Choctaw Nation of Oklahoma (CNO), the Mississippi Band of Choctaw Indians (MBCI), and the Seminole Tribe of Florida (STF). These Tribes have still been consulted per the terms of the LA HMGP PA.

Other Consulting Parties who have signed the LA HMGP PA as Concurring Parties are the Office of Community Development-Disaster Recovery Unit, Calcasieu Parish, Jefferson Parish, Saint Tammany Parish, the City of New Orleans, and the Preservation Resource Center of New Orleans

Stipulation XV.B.i Residential Properties Funded Under Programmatic Treatment Measures: There have been 6,349 properties funded under Large-Scale Sub-Grantee applications. This figure represents both partial- and full-payments within the Office of Community Development program; this is the only Large-Scale Sub-Grantee currently operating within the Hazard Mitigation Grant Program in Louisiana at this time.

Stipulation XV.B.ii Residential and Non-Residential Properties Funded Under Standard Review Process: 668 properties, inclusive of residential and nonresidential properties, have been reviewed under Section 106 between January 31, 2011 and July 31, 2011.


Stipulation XV.B.iii Any Adverse Effects or Potential Adverse Effects Addressed Through STMs or Project-Specific Memorandums of Agreement: There have been no Adverse Effects or Potential Adverse Effects identified, initiated, or resolved within this reporting period.

Stipulation XV.B.iv Summary of Public Input Fielded and outreach Measures Fielded During the Six-Month Reporting Period: There has been no public input, nor has any outreach proven appropriate, during the specified reporting period.

Stipulation XV.B.v Summary of the Execution of Standard Treatment Measures (STMs), Programmatic Treatment Measures (PTMs), and Treatments Under Any Project-Specific Memorandums of Agreement: There has been no need to utilize any of the Standard Treatment Measures, as described in Stipulation X, during the specified reporting period.

Summary of the current status of the FEMA Funded Programmatic Treatment Measures, as described in Stipulation XII are as follows:

  • Stipulation XII.D.1 - SHPO Liaison Position. FEMA is in the process of retaining a contractor to complete this task. This contract is anticipated to be in place by August, 2011.
  • Stipulation XII.D.3 - Analysis and Reporting of Existing Archaeological Collections for Outreach Materials. FEMA is in the process of retaining a contractor to complete this task.
  • Stipulation XII.D.4.a - Digitization of Standing Structures Surveys and National Register Files. FEMA is in the process of retaining a contractor to complete this task.
  • Stipulation XII.D.4.b - Resurvey of Existing National Register Historic Districts. FEMA is in the process of retaining a contractor to complete this task.
  • Stipulation XII.D.4.c - Preparation of a National Register District Nomination for Edgewood Park. FEMA is currently in the process of completing this National Register District Nomination with planned submittal to the Register Hearing in spring of 2012.
  • Stipulation XII.D.3 - Archaeological Testing of City Parks within the City of New Orleans. FEMA is in the process of retaining a contractor to complete this task.
Per Stipulation IX.D.1, FEMA has identified 141 properties which meet the definition of Archaeological Exclusion Properties and notified Consulting Parties in a letter dated June 23, 2011, which provided an update to a notification letter to the Consulting Parties dated May 16, 2011. These 141 properties are currently undergoing the Review Procedure as defined in Stipulation IX.C and D of the LA HMGP PA. FEMA has determined that 18 of these properties have "No Historic Properties Affected." This determination is captured in a letter dated June 30, 2011 that has been sent to SHPO and Tribes as described in the Review Procedure for review and comment. FEMA anticipates beginning site visits, in coordination with Louisiana's Office of Community Development, for the remaining properties in the near future.


Summary of the current status of the Community Education and Outreach Programmatic Treatment Measures funded by GOHSEP, as described in Stipulation XII are as follows:

  • Stipulation XII.D.2.a--Community Education and Outreach Treatment Measures for the Built Environment and Archaeology Program. GOHSEP, in coordination with SHPO, is in the process of finalizing the Interagency Agreement to implement these Treatment Measures.
  • Stipulation XII.D.2.b--Update State Multihazard Mitigation Plan to include information on cultural resources and historic preservation topics. GOHSEP has determined the goals, objectives and action items that need to be included in the State Plan amendment and is in the process of adding the content in the appropriate places throughout the Plan. GOHSEP will continue to coordinate with SHPO to ensure cultural resource and historic preservation issues are satisfactorily addressed prior to finalization of the draft and distribution to the Consulting Parties for review and comment.
