Public Notice Regarding the Section 106 Review and the Development of a Memorandum of Agreement for Three (3) Elevations in the City of New Orleans, Louisiana under the FEMA Flood Mitigation Assistance Grant Program (FMA) – Seeking Public Comment The Federal Emergency Management Agency (FEMA) is issuing this Public Notice as part of its responsibilities under the Advisory Council on Historic Preservation's regulations, 36 CFR Part 800, implementing Section 106 of the National Historic Preservation Act of 1966, as amended (NHPA) . This notice applies to activities carried out by the FEMA Flood Mitigation Assistance Grant Program (FMA). The objective of the FMA program is to reduce or eliminate long-term risk of flood damage to structures insured under the National Flood Insurance Program (NFIP) and to reduce or eliminate claims under the NFIP. The Louisiana Governor's Office of Homeland Security and Emergency Preparedness has applied for FEMA funds to enable the City of New Orleans to assist eligible recipients. The City of New Orleans Government proposes to elevate three (3) residences to provide protection against flooding that may occur in the future. FEMA has determined that these structures are contributing elements to National Register Historic Districts and, as such, are eligible for listing on the National Register of Historic Places. The first residence is located in the 4100 block of D'Hemecourt in the Mid-City National Register Historic District. The remaining two residences are located in the Uptown National Register Historic District in the 1500 block of Broadway St. and the 2900 block of Octavia St. As proposed, the elevations may constitute an Adverse Effect to Historic Properties under 36 CFR 800.5(a)(1). FEMA, in consultation with the State Historic Preservation Office (SHPO) and other consulting parties, is developing a Memorandum of Agreement (MOA) to resolve any adverse effects of the Undertaking and thereby satisfy FEMA's responsibilities in accordance with Section 106 of the NHPA.
